By downloading, installing, or using Rytmo (the "App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the App.
The App is provided by Toni Marence ("Developer"), reachable at toni@marence.at.
The Developer grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on Apple-branded devices you own or control, strictly in accordance with these Terms and the App Store Terms of Service.
You may not:
Rytmo, including its design, code, graphics, and content, is owned by the Developer and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership to you.
Some features of the App may allow you to input or store personal data (e.g. practice records, settings). You retain ownership of any content you create. You grant the Developer a limited licence to process that data solely to operate the App for you.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
The Developer may release updates to the App that add, modify, or remove features. Updates delivered through the App Store are subject to the App Store's policies. Continued use of the App after an update constitutes acceptance of any changes.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Developer does not warrant that the App will be error-free, uninterrupted, or free of bugs. You use the App at your own risk.
To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or in connection with your use of — or inability to use — the App.
The Developer's total liability to you for any claims arising from these Terms shall not exceed the amount you paid for the App (if any) in the 12 months prior to the claim.
The App is distributed through Apple's App Store. Your use of the App Store is governed by Apple's Terms of Service. The Developer is solely responsible for the App and its content; Apple is not a party to these Terms.
These Terms are governed by the laws of Austria, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Austria.
The Developer reserves the right to modify these Terms at any time. Changes will be posted at this URL with an updated date. Your continued use of the App following any changes constitutes acceptance of the new Terms.
