By downloading, installing, or using Rytmo (the "App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the App.
The App is provided by Toni Marence ("Developer"), reachable at app@marence.at.
The Developer grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on Apple-branded devices you own or control, strictly in accordance with these Terms and the App Store Terms of Service.
You may not:
Rytmo, including its design, code, graphics, and content, is owned by the Developer and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership to you.
Some features of the App may allow you to input or store personal data (e.g. practice records, settings). You retain ownership of any content you create. You grant the Developer a limited licence to process that data solely to operate the App for you.
Rytmo offers optional auto-renewable subscriptions. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and can be managed or cancelled in your App Store account settings. Apple’s standard Licensed Application End User License Agreement (EULA) also applies.
Rytmo is a personal habit tracker, not a medical device. Habit templates such as exercise or meditation timers are general suggestions only. Consult a professional before starting a new exercise routine and stop if you feel pain or discomfort.
Linking a habit to a partner app is optional and requires the partner app to be installed. The partner apps are the Developer’s own apps. Each partner app has its own privacy policy and terms, which apply to your use of that app.
For a linked habit Rytmo shows one of three states: Synced, Waiting or Out of sync. “Out of sync” can be fixed with one tap. Completions that the partner app reports while a link is out of sync may not be counted.
Which partner apps are offered can change. An app can be added to or removed from the list; links that already exist keep working.
Deleting the habit or the link ends the sync and cannot be undone. A new link starts without the earlier progress.
The sync service is provided as is, without a guaranteed uptime. The Developer may change or discontinue it.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
The Developer may release updates to the App that add, modify, or remove features. Updates delivered through the App Store are subject to the App Store's policies. Continued use of the App after an update constitutes acceptance of any changes.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Developer does not warrant that the App will be error-free, uninterrupted, or free of bugs. You use the App at your own risk.
To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or in connection with your use of — or inability to use — the App.
The Developer's total liability to you for any claims arising from these Terms shall not exceed the amount you paid for the App (if any) in the 12 months prior to the claim.
The App is distributed through Apple's App Store. Your use of the App Store is governed by Apple's Terms of Service. The Developer is solely responsible for the App and its content; Apple is not a party to these Terms.
These Terms are governed by the laws of Austria, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Austria.
The Developer reserves the right to modify these Terms at any time. Changes will be posted at this URL with an updated date. Your continued use of the App following any changes constitutes acceptance of the new Terms.
